NEW DELHI - The Central Bureau of Investigation (CBI) Friday told the Supreme Court that Congress leader Sajjan Kumar's petition challenging framing of charges against him in an anti-Sikh riot case by the trial court was just to delay the trial and should be dismissed.
'The petition has been filed with the only objective of delaying the trial,' the CBI told the apex court bench of Justice P. Sathasivam and Justice B.S. Chauhan.
Stating that there was no substantial question of law involved in Sajjan Kumar's petition, the CBI said there was nothing in the Special Leave Petition to justify interference by the apex court. The court was told that the grounds mentioned in the petition were the same as those already raised in the courts below.
The investigating agency said: 'It is well settled that at the stage of framing of charges, the material on record has not to be examined meticulously by weighing it in a golden scale.'
'A prima facie finding of sufficient material showing grave suspicion is enough to frame charges,' the investigating agency said... (read more at : Sify News )
'84 riots: 'Delhi police conducted sham probe to shield Sajjan'
NEW DELHI: The Central Bureau of Investigation (CBI) today told the Supreme Court that the special anti-riots cell of the Delhi Police had conducted "sham investigations and farce prosecutions" in the 1984 anti-Sikh riots to apparently shield key accused – senior Congress leader and former MP Sajjan Kumar.
In an affidavit, the investigating agency urged the Supreme Court to vacate the stay it granted on Kumar's trial in August 13 after the former MP challenged his prosecution.
The CBI pleaded that the stay "seriously prejudiced" the prosecution against the Congress leader.
A Bench of Justices P Sathasivam and B S Chauhan -- while taking on record the affidavit – posted to September 7 the final hearing of the agency's plea to prosecute Kumar for the Delhi Cantonment riots.
"Mr Dave, nobody is insensitive," the Bench said when senior counsel Dushayant Dave, appearing for one of the victims, asked the court to vacate the stay on grounds that it involved the emotions of thousands of people.

Police conducted sham probe into 1984 riots: CBI
NEW DELHI - Not only are the walls closing in on the former Congress MP, Sajjan Kumar, but the Delhi police team that led the probe into the 1984 anti-Sikh riots may be facing serious action as the Central Bureau of Investigation (CBI) has dug up some dirt about the special anti-riots cell.
The probe agency, which has taken over the anti-Sikh riots case, told the Supreme Court on Friday, Aug 27 that the police cell conducted "sham investigations and farce prosecutions" to shield ex-MP Sajjan Kumar.
Questioning the intention of the anti-riot cell of Delhi police in filing status reports on Jul 31, 2008 in the trial court while the probe was being conducted by CBI, the agency said, "There was no occasion for the Delhi Police to deal with the case once the entire material was supplied to the CBI by the government of India from the custody of Delhi Police (on Oct 10, 2005)."
In its affidavit, the CBI also accused Sajjan Kumar of attempting to delay the trail in one way or the other and urged the apex court to vacate the Aug 13 stay granted by it.
The Supreme Court bench, comprising of Justices P Sathasivam and B S Chauhan, posted the final hearing on CBI's plea to Sep 7.
The agency hopes to prosecute Kumar for the riots under Delhi Cantonment police station in which 60 people were killed.
